SEXUAL AND HISTORICAL ASSAULT

Historical sexual assault involves violence that happened in the past.  Survivors are often unable to come forward with the trauma they have endured when it happens.  For this reason, there is no restriction on the time period (limitation period) during which a sexual assault claim can be pursued.  A significant hurdle in these cases can be recovering compensation from the assailant, who may have limited assets.  However, there may be options for recovery, both against assailants or the institutions that enabled the wrongful behaviour.

SLIP AND TRIP AND FALL CLAIMS

Claims arising from falls are becoming more frequent among our aging population.  These types of accidents are common in cold climates given the prevalence of ice and snow.  The combination of age and hazardous surfaces can result in significant injuries, including fractured hips or other bones, and brain injuries.  Occupiers of premises owe a duty to ensure that visitors are reasonably safe, including safe from the risks posed by slip and trip hazards.  A failure to adhere to this responsibility can result in liability for the occupier, and significant compensation for the victim. 

CATASTROPHIC INJURIES AND BRAIN INJURIES

Catastrophic injuries are severe injuries that cause long-term or permanent damage to a person's physical, emotional, or cognitive abilities.  They are frequently seen in situations where the injuries involve damage to the spinal cord, loss of limb, and brain injury.  In the case of catastrophic injury, the focus is on securing the victim's immediate and long-term medical and financial needs. 

MOTOR VEHICLE AND ROAD ACCIDENTS

Accidents involving cars, buses, motorcycles, bikes and pedestrians can result in a wide variety of injuries.  Success will often turn on a comprehensive understanding of the rules of the road.  Many victims of bus, bike and pedestrian accidents are not aware that the driver of the vehicle involved is presumed to be at fault absent evidence to the contrary.​​

CARBON MONOXIDE POISONING

CO poisoning is called "the silent killer" because there is no immediate warning that you have been exposed; at least not until it is too late.  CO poisoning can be caused by anything from a negligently modified exhaust system to a lack of detection systems.  Injuries arising from CO poisoning  have been seen recently in ice skating arenas within insufficient detection systems.  The injuries sustained as a result of carbon monoxide poisoning can result in permanent injuries and impairment, and may be deserving of significant compensation.

BURN INJURIES

Burn injuries can be a devastating and life altering event.  If the burn is caused by the negligence of someone else, significant compensation may be awarded. 

AIRPLANE INJURIES

Airplane injury claims are subject to a complex set of laws and conventions that can be difficult to navigate.  If you have been injured on a domestic flight, you may be entitled to compensation if the injury was caused by the negligence of the airline or someone on it.  If you have been injured on an international flight, you may be entitled to compensation regardless of whether someone else was negligent.
